Diamond Ateliers: Terms and Conditions
1. Agreement to Terms
By engaging Diamond Ateliers (hereinafter referred to as the “Company”) for any goods or services, the customer (hereinafter referred to as the “Customer”) hereby acknowledges and agrees to be bound by the following Terms and Conditions, which shall govern all transactions, including but not limited to bespoke jewelry production, repairs, modifications, and aftercare services, as may be amended from time to time.
2. Definitions
For the purposes of this Agreement:
CAD: Refers to Computer-Aided Design employed in the customization of jewelry.
Production Timeline: Denotes the duration required to complete bespoke jewelry production, commencing from the date of approval of the CAD design by the Customer.
Standard Services: Refers to resizing, polishing, and engraving provided by the Company.
Customer-Provided Materials: Refers to materials supplied by the Customer for incorporation into the final product.
3. Deposit Policy
3.1. All deposits paid towards the production of jewelry are strictly non-refundable and non-transferable under any circumstances.
3.2. Any additional charges arising from modifications or services outside the scope of Standard Services shall be communicated to the Customer in advance and shall require the Customer’s explicit written approval prior to execution.
3.3. Estimated delivery timelines shall be provided only upon final approval of the design and are subject to change at the Company’s discretion.
4. Production Timelines
4.1. The standard production timeline is 8–12 weeks from the date of CAD design approval.
4.2. Any expedited timelines shall be offered solely at the Company’s discretion, on a goodwill and best-effort basis, and without guarantee.
4.3. If the production timeline coincides with public holidays or includes holidays such as Christmas or New Year, the timeline shall be extended accordingly. The Customer shall be duly notified of any such extensions.
4.4. While the Company endeavors to adhere to the stipulated timelines, unforeseen delays may occur, and the Company shall not be held liable for any losses or damages arising therefrom. Customers are advised to plan accordingly, particularly during peak seasons.
5. Complimentary Services
5.1. The Company shall provide complimentary resizing, polishing, and engraving services, subject to the following terms and conditions:
Resizing and Polishing: The Customer acknowledges and accepts that resizing and polishing may result in surface scratches, slight alterations to the shape, or changes to the texture of the ring.
Engraving Services: The Customer acknowledges and accepts that adjustments to engraving alignment, appearance, or clarity may be necessary.
5.2. These complimentary services are provided as a goodwill gesture and shall not constitute grounds for any disputes, refund requests, or financial compensation claims.
6. Resizing Terms
6.1. Complimentary resizing shall be limited to adjustments within +/- 2 sizes of the original size.
6.2. Rings falling within the following categories shall be deemed ineligible for resizing:
Full eternity bands.
6.3. Resizing beyond the aforementioned range may be offered at the sole discretion of the Company, subject to the following conditions:The Customer expressly acknowledges and accepts all risks associated with such resizing, including but not limited to aesthetic changes, structural modifications, or alterations to the design’s integrity.
The Customer shall bear all additional fees associated with such resizing.
6.4. Platinum Rings: The Customer acknowledges that resizing platinum rings shall result in a visible joint mark due to the inherent properties of the material. The Customer further acknowledges that:Resizing may lead to differences in color and finish at the joint area.
The structural integrity of the ring may require additional reinforcements, resulting in subtle design changes.
While the Company employs best practices to minimize visible effects, these outcomes are inherent to resizing platinum.
7. Material-Specific Policies
7.1. White Gold: The Customer acknowledges that white gold may naturally yellow over time due to its alloy composition and may require periodic rhodium plating to maintain its original appearance.
7.2. Platinum: The Customer acknowledges that platinum, while durable, is prone to developing a patina over time, which can affect its appearance. Periodic polishing may be required to restore its original finish.
8. Warranty Policy
8.1. All warranty claims shall be subject to professional evaluation by the Company.
8.2. The warranty shall exclusively cover manufacturing defects and shall expressly exclude the following:
Normal wear and tear over time.
Accidental damage caused by misuse, impact, or exposure to chemicals or harsh environments.
Modifications or repairs performed by third parties without prior authorization from the Company.
8.3. The Company reserves the right to reject warranty claims where any of the aforementioned exclusions apply.
9. Liability Disclaimer
9.1. The Company shall not be held liable for the loss, theft, or damage of jewelry items while in its possession for services such as repairs, modifications, or resizing.
9.2. The Customer is strongly advised to obtain comprehensive insurance coverage for their jewelry to mitigate potential risks.
10. Insurance Recommendations
10.1. The Customer is advised to procure independent insurance coverage for high-value jewelry. The Company disclaims all liability for losses or damages occurring outside of its direct control.
11. Dispute Resolution
11.1. Any disputes arising out of or in connection with these Terms and Conditions shall first be resolved amicably through mutual discussions.
11.2. Failing amicable resolution, disputes shall be submitted to mediation or arbitration in accordance with the laws of Singapore, which shall govern this Agreement.
12. Return and Exchange Policies
12.1. The bespoke nature of the products renders them ineligible for returns or exchanges.
12.2. Any exceptions to this policy shall be at the sole discretion of the Company and shall require prior written agreement.
13. Jewelry Care and Maintenance
13.1. The Customer acknowledges receipt of guidelines for proper jewelry care. Failure to adhere to these guidelines shall void any applicable warranty.
13.2. The Company may provide periodic maintenance services, which may be subject to additional charges.
14. Intellectual Property Rights
14.1. All CAD designs and prototypes created by the Company shall remain its sole and exclusive intellectual property.
14.2. The Customer shall not reproduce, replicate, or use such designs with any third party without the prior written consent of the Company.
15. Customer-Provided Materials
15.1. The Customer acknowledges all inherent risks associated with providing their own materials, including but not limited to damage during setting or modifications.
15.2. The Company disclaims all liability for defects or damages attributable to Customer-provided materials.
16. After-Sales Services
16.1. Complimentary after-sales services shall be limited to the original Customer.
16.2. Additional services outside the scope of complimentary offerings shall be chargeable and subject to the Company’s prevailing rates.
17. Special Considerations for International Orders
17.1. The Customer shall bear all shipping costs, customs duties, and taxes applicable to international orders.
17.2. The risk of loss or damage during international shipping shall be borne solely by the Customer unless otherwise agreed in writing.
18. Customer Consent
By signing this Agreement or placing an order with the Company, the Customer hereby affirms that they have read, understood, and agreed to be bound by these Terms and Conditions.
19. Privacy Policy
19.1. The Company shall process all Customer data in strict accordance with applicable privacy laws and regulations.
19.2. The Company shall not share Customer data with third parties without explicit written consent.
20. Modification of Terms
20.1. The Company reserves the right to amend these Terms and Conditions at any time without prior notice.
20.2. Customers are encouraged to review the Terms and Conditions periodically to remain informed of any updates.
21. Termination Clause
21.1. The Company reserves the right to terminate any agreement or refuse service under circumstances including, but not limited to, non-payment or abusive behavior by the Customer.
